No, that's what the military thinks happened and is investigating.

Key word "investigating".
They have to "investigate" before they can convict. There is not much doubt in
most of the cases under "investigation". Kind of like the police know that the
dead body is the result of someone being murdered, but they have to
"investigate" to get enough information to know who, specifically, to charge,
and then convict.
