Hi,
My name is Amir Ali Tayyab and I was operating as "aatayyab" on
www.rentacoder.com as a member only for two months with top10 ratings
there by my 5 projects within that short span. And then I was struck
with a bad surprise by a non-professional buyer, unfair arbitration by
a rentacoder.com arbitrator and owner of www.rentacoder.com in my last
project where I suffered these losses;
1. they confiscated my rightful money to be paid by the buyer and
returned it back to him. The buyer name is Mr.Terence Brown
(tbrown223@comcast.net) and he was operating as "safrica2" buyer on
www.rentacoder.com . This buyer had 10 arbitrations out of his total 40
which he always won with 10 different coders. Hence a sense of favorism
towards buyers is clearly visible and this buyer always used such an
unfair favorism to deceive and rip off many coders of their rightful
money like myself and run away with completed projects under the
protection of "deceptive" existence of fraudulent internet websites
like www.rentacoder.com
2. they appointed an arbitrator Mr.Ajay Bathija
(AjayBathija@exhedra.com) to resolve my issue with the buyer, but he
took sides of the buyer and turned down all of my requests for
professional testing/arbitration.
3. they rated me as MINUS THREE on their website in that specific
project and;
4. they deducted money from my own account as a penalty
5. they issued me warnings to withhold my own money left in my account
if i did not stop pursuing it legally.
I protested all this to owner of www.rentacoder.com, Mr.Ian Ippolito
(IanIppolito@exhedra.com), but he too took unfair side of his
arbitrator and the buyer. Before signing up with rentacoder.com, I was
deceived into believing them due to their display of memberships by
www.BBB.org and www.SquareTrade.com . Now, I have started the
complaint process not only at these websites but with all legal
authorities of their territories and warning general public against
using such a deceptive website like www.rentacoder.com or working in
any way with Mr.Ian Ippolito, Mr.Ajay Bathija and Mr.Terence Brown.
I am based in Pakistan and I was ripped off my rightful money by these
persons and website via internet who are located in USA.
I will keep you all posted about the developments taking place to
prosecute such internet fraud. I have met a few of the coders who feel
the same way and I plan to gather all such evidence and legally
fighting such fraudulent websites or persons. I have all the emails and

attached herewith in zipped format for your detailed review.

My account is frozen. Should I consider this a beginning of something
else from your side? If so, you will find me NOT ready to commence
unnecessarily long and expensive legal battle only for mere 100$ or
your bad rating award. I am not interested in wasting my time or money
anymore with you or your site. I would, however, do all that is
possible via normal PR campaigns against you, your site, your
arbitrator and your buyer who are resposible to bring it all onto
themselves. You are lucky that I am not a US Citizen and that I am
located in Pakisan. Otherwise, you would be on the recieving end, not
me. So, temporarily, please celebrate your BIG victory "temporarily".
One last thing I wanted to bring into your notice, was that your
"wisdom" of asking me to get market research from "big" groups like
Edmunds or Gartner would have cost me a minimum hundred times the
amount I bid on this specific project. Hence, I delivered the best
possible results within the scope of the project or bid.
Now, as you have declared a war yourself by freezing my account, I
would request you to be on guard on each and every possible internet
platform. Yours is a "virtual" success that will definitely be turned
into a "virtual" disaster, I assure you. Try to appoint a highly
competitive legal or professional PR guy to defend yourself, Mr.Ajay
and Mr.Terence (safrica2). I welcome your invitation to a confrontation
where I got nothing to lose, but you got a lot. I have recieved a quite
few similar coder complaints against your unfair arbitration process
and this needs to be reported to all authorities, organizations and
public in gerneral via all possible means. All of us will make sure
that you can't keep on earning revenues from your present or potential
coders or buyers via your "deceptive" website display of "Certified by
BBB and SquareTrade".
Salute to your "wisdom" to select confrontration and "messing up"
instead of an "amicable" solution. I would suggest you a better way to
rob, go to a bank with a loaded pistol or preferably watch movie "Die
Hard" and see how bad guys in that movie planned to rob the richest
person on earth, instead of running a "deceptive" website called
"rentacoder.com".
Shame onto you, Mr.Ajay and Mr.Terence. I never knew that I would hate
anyone ever in my life, but now, I must admit I hate you 3 guys due to
your greed of money and your preference to money instead of catering to
any professional norms of your own profession and/or justice. So,
celebrate your success into creating one guy on this earth who hates
you due to your injustice and greed of money. You are pure waste of
flesh and blood on this earth and I am going to make sure people like
you can't go on living a normal life under "disguise" of a website,
coder, buyer or a professional. All of you will be brought to justice
not only by your own territorial authorities, but by the general public
itself. You have my promise until my death.
There is no question of the existence of "satan" and its powers, but
the Creator of "satan", of course got more powers and knows how to
empower its beleivers into defeating these so-called "satanic" persons
like you. Please change your religion and name it "money" instead of

Again, the review showed that what you are alleging above is not
accurate. You didn't do the proper research you should have done
BEFORE you started the project by consulting Edumunds or Gartner group
or the like to get the proper marketshare. You started by skipping
this step and "guessed". This mistake ended up messing up your
whole project.
Now you are following up that mistake with the additional mistake of
refusing to admit to what happened. And as a result you will never
learn from it until you do, and you will doom yourself to repeat it.
How you take responsibility is up to you and beyond my control. If
you're going to slander us and post untrue things about us, that is
also beyond my control. But I cannot change the arbitration result
(including the rating number) due to you doing this, when it is
accurate and true.

Amir, did you read the email I attached? That was the review. There
is no 3rd arbitrator that would be brought into this.

Based on my reading of the review I cannot agree this is accurate.
If this is your FINAL decision that whatever so far communicated to
me, is all that you got, then I am forced to proceed with related
authorities, organizations and forums which I am sure you and I would
never like to end up with.
Again, I am interested in resolving this issue peacefully within
ourselves and I request you to give it a second thought. I would be the
last person to argue as I have many other important things on my desk
to look into. However, this unfair arbitration has disturbed me and my
professional repute a lot and I am not going to simply ignore it and
move on with the life as I believe firmly in justice for everyone, not
only for myself.
While I can't control you, I can tell you that it would be biased,
unethical and unfair to change the result of an arbitration because
someone was going to publish falsified and/or slanted information about
us. The entire integrity of the arbitration system would be
compromised, which cannot be allowed.

That is not what you were promised, because that is not the way the
process works. The arbitration is reviewed by a 2nd arbitrator and if
a mistake was made it is corrected. If a mistake was not made then
nothing is changed. In your case, no mistake was made, so nothing
could be changed.
Amir, if you did not understand what you did incorrectly before, and
asked for a review, and then understood what you did wrong after it was
explained to you....that would be a good sign.
However in your case, you have no facts or case to stand on, and are
still arguing. It appears that you are arguing just to argue. If this
is the case, I will warn you that doing this is not only not
productive, but won't be tolerated...and as we discussed earlier,
your account would be closed.

reviewed by a senior arbitrator. If it is verified then the mistake
will be corrected. On the other hand, if it isn't, then the result

I have a professional competence complaint agian Mr.Ajay who was
arbitrator of my case. He has unfairly returned my due money ($100) the
buyer (safrica) and rated me 3. Instead of technically verifying my
research report, he unfairly and without any reason awarded me this
penalty.
Since I joined your website by seeing BBB and SquareTrade seal, I am
sure yours is a fair organization that protects not only buyers but
coders too. Could you please help me in any way you can and don't let
this matter explode on BBB, SquareTrade and internet forums worldwide?
I am very much frustrated and angry towards non-professional and
incompetent behaviour of one of your employees Mr.Ajay (technical
arbitrator) working in Rent A Coder owned by Xhedra, Inc.
Please take the appropriate action on this complaint. Or if there is
another way to file the complaint and start the process, let me know.

I want to make it clear that I am examining this to see if a mistake
was made. If it was it will be corrected. So there should NEVER be a
need to address another party about an arbitration outside of it.
Doing so is considered conduct unbecoming of a professional and will
result in termination. If you have a legitimate case, such means are
not necessary..they are the last refuge of someone who is only looking
to argue. I hope this is not your case, Amir.

The contract in this project was to review "Top five products in
terms of market share" in 3 areas.
When Amir presented his rough draft to Terrence, Terrence said:
"One question - what is the basis for your market share? For the
network management or infrastructure companies, I do not where you are
getting these firms from, but where did companies like Remedy, Granite,
HP (Openview), Netcracker, Zhone place? These are multi billion dollar
companies."
Amir responded:
" The basis of my research are industry articles by the experts and
websites like cnet and many other online resources. I was not just
collecting "biggest" companies, as i targetted to have it for small to
medium enterprise.."
Looking at the contract at this point, it is vague, meaning it
doesn't say whether market share should be determined for products in
the SME field or the Enterprise field. So if it's vague, the seller
only had to meet the vague requirements. So at this point, no one has
done anything legally wrong. However I should also point out that from
a professional standpoint, Amir should have asked questions to clarify
which market was to be investigated. Simply choosing the "small to
medium business market" randomly is not considered proper or
professional on the Seller's part, because it can often result in
wasted work or incorrect work...as seems to have happened here.
Amir adds:
" However, if you want me to incorporate those companies' data that
you mentioned, I am ready to do it as well"
Amendments to the contract occur in the private communication. They
require both parties to agree to it. So Amir says he is willing to
amend the contract to include big companies, and states that he will
investigate the large companies if Terrence wants him to. If Terrence
agrees to this, then the contract is amended.
Terrence responded:
" The basis of your search are industry articles by the experts and

the articles in an appendix?

editions, I have modified the report to reflect it accordingly. Looks
good, but I do not believe these are the top 5 respectfully."
So Terrence tells Amir he does wish him to research the large
companies. At this point the contract is amended.
Amir then said:
" I believe I have given it already 3 times more of my valuable time
and since the scope of your original project has clearly changed as of
your latest comments, I would humbly request you to consider it over
from my side. If you don't agree, I welcome any mediation process by
RentACoder.com management."
Apparently Amir then says the product is out of scope (but not why).
This is not correct if he is referring to the redoing of the report for
large companies, since he already agreed to amend the contract. So I
will assume the best argument for Amir and assume he is referring to
the referencing of the articles that he alleged he used.
At this point should those articles be included?
"Top five products in terms of market share". To do this, one has
to (before doing anything else) obtain a high level report detailing
the market share of each. Amir can obtain this from any of the
financial companies that specialize in this research including Edmunds,
or companies like Gartner Group, etc.. As market share changes from
quarter to quarter and year to year, Amir would have to do this to meet
the contract. Otherwise he would be guessing, and would not be
producing the top 5 products.
When questioned on this, later Amir alleges:
" I did an independent market survey without any outside help of
other surveys or links/resources since there were NONE online except a
few articles."
At this point, Amir seems to be saying that he did not actually use a
financial or analysis company to obtain the market share information
but did a survey on his own. If he did, then how did he guarantee that
he hit the top 5 companies by market share? To do so, he would have to
interview each and every company in the field and ask them for their
marketshare. Most are not willing to give this out. And most likely
they are hundreds of companies. But if he could somehow do this, then
he could actually accomplish this without going to a 3rd party company
that specializes in this information. However, if he missed even one
company, or if one company did not give them their marketshare (and as
said before, most will not) then this would not be a way to determine
the top 5 companies by marketshare and would not meet the contract.
Regarding proof, My resume is attached and it is a clear and present
proof of my 18 years of affiliation with software industry. Now,
whenever you ask a doctor to list the top-5 medicines to cure a simple
headache out of 1,000, it is that "18 years" or "professional"
knowledge/expertise that only he can come up with the INDEPENDENT
analysis of top-5 as per his own opinion. I never cited or intended to
cite any reference in my bid or any effort to do so, neither it was
asked in particular by Terence in his original post. All of the record
is in front of you and I don't need to repeat the same thing over and
over again.
At this point, Amir is referencing his resume, as a reason that he
confirmed the top 5 products by marketshare. However 18 years of

Based on the above it appears that at no time did Amir produce any
evidence that he had done the necessary research to determine the top 5
products by marketshare. The appropriate way to do this project would
be to contact a financial company such as Edumunds or an analyst
company such as Gartner Group. However, it appears that Amir alleges
he merely picking out the companies he "felt" were the top 5.
Given the fact that the top 5 changes from month to month, this was not
an accurate, reliable or professional means of determining the
appropriate marketshare of the companies.

company's top-5 position, this tester/arbitrator cancelled the bid and
awarded me a penalty which is UTTERLY non-sense.
as i said earlier, i would like to give your senior or the top
arbitrator a chance since i believe in solving matters amicably and
avoiding any extreme things like BBB/SquareTrade/internet forums or
legal stuff. I really feel sorry to utter these names, but Ajay's
non-professional response prompted me to say them and please accept my
apology if you understood it as a threat.
It is not a matter of 100$ alone, now it has grown bigger since now i
have been penalized and the buyer got whatever he wanted for free. this
buyer got 10 arbitrations out of his 40 total projects which is
suggesting me a clear pattern of things going on. i will definitely
follow up with safrica2 personally and directly out of the RAC domain,
but as i said, RAC should not become party to any such quarrels if any
arbitration fails which i am afraid Mr.Ajay left me no other choice to
think otherwise.

Just remember that if you promise something onsite, then that amends

Well I'm glad we at least able to end on a positive note. However
there are a few things I must address:

Arbitration protects you as a coder (including Mr. Ajay)...but you do
have to honor your contract to get that protection. There are times to
put things into arbitration, so you should know when those times are,
so you can protect yourself.
Regarding:
" I will never ever give any client anything out of the scope of
original contract"
That is not necessarily the lesson to learn here, as even if you
hadn't done that, there is still the problem of how you did your
research for the small/medium enterprise market.
What I believe happened is that you put in a very hard (and expensive)
effort by calling companies, etc., but unfortunately the method you
chose was flawed from the start and doomed you to failure. Your first
step should have been to just go to Edumunds, Gartner Group, or a
company like that and get the top 5 companies by marketshare. You
could have avoided the expense of calling. Had you done this, and done
the small/medium enterprise market you would have at least have met the
contract. Then it would have been up to you whether you wished to do
more research on the large market "for free" to make the customer
happy, or wished to just end it and get paid (there are times when one
or the other might be better for you..it is completely your choice on
which you'd prefer to do). Next time you know.

The nature of every disputed arbitration is that one party will win and
one will lose, and only one will feel "amicable" at the end. The
end result can only be based on the fact...there is no additional
"negotiation" allowed over the end result, because that would be
both unethical and allow bias to enter into the final judgement..
Amir, based on the below it appears you made several key mistakes in
this project, starting with not first determining what the top 5
projects would be by marketshare (which changes month to month).
Additionaly, you agreed to do the work on "large companies" in the
onsite documentation (amending the contract), but didn't live up to
it.
Had you simply lived up to your contract, you would have been paid, but
since you did not, you cannot be paid.
I would prefer to see you learn from you mistakes so that they won't
repeat themselves...but in the end, that is something I have no control
over and only you control.

The contract in this project was to review "Top five products in
terms of market share" in 3 areas.
When Amir presented his rough draft to Terrence, Terrence said:
"One question - what is the basis for your market share? For the
network management or infrastructure companies, I do not where you are
getting these firms from, but where did companies like Remedy, Granite,
HP (Openview), Netcracker, Zhone place? These are multi billion dollar
companies."
Amir responded:
" The basis of my research are industry articles by the experts and
websites like cnet and many other online resources. I was not just
collecting "biggest" companies, as i targetted to have it for small to
medium enterprise.."
Looking at the contract at this point, it is vague, meaning it
doesn't say whether market share should be determined for products in
the SME field or the Enterprise field. So if it's vague, the seller
only had to meet the vague requirements. So at this point, no one has
done anything legally wrong. However I should also point out that from
a professional standpoint, Amir should have asked questions to clarify
which market was to be investigated. Simply choosing the "small to
medium business market" randomly is not considered proper or
professional on the Seller's part, because it can often result in
wasted work or incorrect work...as seems to have happened here.
Amir adds:
" However, if you want me to incorporate those companies' data that
you mentioned, I am ready to do it as well"
Amendments to the contract occur in the private communication. They
require both parties to agree to it. So Amir says he is willing to
amend the contract to include big companies, and states that he will
investigate the large companies if Terrence wants him to. If Terrence
agrees to this, then the contract is amended.
Terrence responded:

So Terrence tells Amir he does wish him to research the large
companies. At this point the contract is amended.
Amir then said:
" I believe I have given it already 3 times more of my valuable time
and since the scope of your original project has clearly changed as of
your latest comments, I would humbly request you to consider it over
from my side. If you don't agree, I welcome any mediation process by
RentACoder.com management."
Apparently Amir then says the product is out of scope (but not why).
This is not correct if he is referring to the redoing of the report for
large companies, since he already agreed to amend the contract. So I
will assume the best argument for Amir and assume he is referring to
the referencing of the articles that he alleged he used.
At this point should those articles be included?
"Top five products in terms of market share". To do this, one has
to (before doing anything else) obtain a high level report detailing
the market share of each. Amir can obtain this from any of the
financial companies that specialize in this research including Edmunds,
or companies like Gartner Group, etc.. As market share changes from
quarter to quarter and year to year, Amir would have to do this to meet
the contract. Otherwise he would be guessing, and would not be
producing the top 5 products.
When questioned on this, later Amir alleges:
" I did an independent market survey without any outside help of
other surveys or links/resources since there were NONE online except a
few articles."
At this point, Amir seems to be saying that he did not actually use a
financial or analysis company to obtain the market share information
but did a survey on his own. If he did, then how did he guarantee that
he hit the top 5 companies by market share? To do so, he would have to
interview each and every company in the field and ask them for their
marketshare. Most are not willing to give this out. And most likely
they are hundreds of companies. But if he could somehow do this, then
he could actually accomplish this without going to a 3rd party company
that specializes in this information. However, if he missed even one
company, or if one company did not give them their marketshare (and as
said before, most will not) then this would not be a way to determine
the top 5 companies by marketshare and would not meet the contract.
Regarding proof, My resume is attached and it is a clear and present
proof of my 18 years of affiliation with software industry. Now,
whenever you ask a doctor to list the top-5 medicines to cure a simple
headache out of 1,000, it is that "18 years" or "professional"
knowledge/expertise that only he can come up with the INDEPENDENT
analysis of top-5 as per his own opinion. I never cited or intended to
cite any reference in my bid or any effort to do so, neither it was
asked in particular by Terence in his original post. All of the record
is in front of you and I don't need to repeat the same thing over and
over again.

It is not a matter of 100$ alone, now it has grown bigger since now i
have been penalized and the buyer got whatever he wanted for free. this
buyer got 10 arbitrations out of his 40 total projects which is
suggesting me a clear pattern of things going on. i will definitely
follow up with safrica2 personally and directly out of the RAC domain,
but as i said, RAC should not become party to any such quarrels if any
arbitration fails which i am afraid Mr.Ajay left me no other choice to
think otherwise.

Since Ajay is supposedly a newbie and quite an in-experienced to
understand anything about the project, let alone you appointed him as
an arbitrator. However, everyone needs training, but please make sure
you don't put "internees" like Ajay on serious assignments like
arbitrating issues, irrespective of the volume/size of the project.
Now, to answer your question, the buyer alleged that i did not include
XYZ company into my report which was of course professionally answered
by myself that such companies are good, but can't come in top-10. now,
he insisted me to include it which was not included in his initial bid
or during our communication BEFORE i actually started the work. after
the work starts, someone can't come up with new requirements, which i
am sure you will agree too.
now, having complete confidence in professional arbitration, i TESTED
your arbitrator's working which frankly i found totally in-competent
and simply frustrated me instead. instead of actually TESTING the XYZ
company's top-5 position, this tester/arbitrator cancelled the bid and
awarded me a penalty which is UTTERLY non-sense.
as i said earlier, i would like to give your senior or the top
arbitrator a chance since i believe in solving matters amicably and
avoiding any extreme things like BBB/SquareTrade/internet forums or
